OFFER AGREEMENT

Definition of terms:
Site – a website located on the Internet at https://shoesbar.com.ua, including all its web pages.
Goods – goods, images and descriptions of which are posted on the Site.
Public offer – a public offer of an online store addressed to an unspecified circle of persons shoesbar.com.ua in the person of an individual entrepreneur Kuzmenko O.M. EDRPOU code 2791419441, city of registration 50089, Dnipropetrovsk region, city of Kryvyi Rih. e-mail: shoesbar.com.ua@gmail.com regarding the conclusion of an electronic contract for the sale of Goods on the terms and conditions specified by the online store shoesbar.com.ua.
User/Buyer – a person who views information on the Site and/or orders Goods using the Site's technical tools.
Order – a properly executed and sent request by the User to purchase the Goods selected by him, indicating the data necessary for identification.
Acceptance – the User's performance of actions aimed at accepting the terms and conditions of this Public Offer.

1. General Provisions.
   1.1. This information posted on the Site contains the terms and conditions for purchasing the Goods and is a Public Offer of the online store shoesbar.com.ua, addressed to an unspecified group of persons - users of the Site.
   1.2. Acceptance is the fact of the Order by the User/Buyer, which is the expressed intention of the User/Buyer to purchase the Goods selected on the Site.
   1.3. By accepting, the User/Buyer certifies his full and unconditional agreement with all the provisions and rules of this Public Offer without any exceptions and restrictions, and confirms that he is familiar with its terms and conditions by the time of making the Acceptance.
   1.4. The Agreement is considered concluded from the moment of confirmation and acceptance of the Order by the online online store shoesbar.com.ua.
   1.5. Payment for the Goods is made by non-cash payment, in accordance with the conditions specified on the Site in the section «Delivery and payment» – https://shoesbar.com.ua/dostavka-oplata

2. 2. Information about the Goods.
   2.1. The presented Goods contain the name, photos of samples and text information about the Goods, available variations and sizes, cost per unit of the Goods, etc.
   2.2. The information posted on the Site is for informational purposes only.

3. Ordering Procedure.
3.1. The User/Buyer can place an Order for any Product that is available for ordering on the Site.
3.2. The Product is made to order, therefore, when placing an order, the User/Buyer indicates his/her measurements in accordance with the points https://shoesbar.com.ua/individualny-zakaz

4. Delivery of the Product.
4.1. Delivery of the Products, according to the Orders, is carried out by delivery services throughout Ukraine and beyond its borders in accordance with the conditions specified on the Site in the section «Delivery and payment» – https://shoesbar.com.ua/dostavka-oplata
4.2. Together with the Goods, the Buyer is provided with a goods receipt in electronic form.
4.3. Upon receipt of the Goods, the Buyer has the right to check the Goods for compliance with the Order, for quality, completeness, and also carefully try on the Goods.
4.4. The fact of acceptance of the Goods by the Buyer is the agreement to pick up/accept the Goods from the delivery service, affixing a signature to the documents confirming the delivery of the Order.
4.5. By Accepting this Public Offer, the Buyer fully and unconditionally agrees to the Rules for the carriage of goods of the delivery service Companies. The terms of such Rules can be found on the websites of the relevant Companies.

5. Return of Goods. Warranty for Goods.

5.1. Goods made to order and made to measure are not subject to return.

5.1.1. In the event that the Goods do not fit the dimensions provided by the User/Buyer when placing the order, the online store shoesbar.com.ua may correct the finished product. In this case, the delivery of the Goods and the costs of correction are paid by the User/Buyer.
5.2. Return of Goods of proper quality.
5.2.1. Return of Goods of proper quality is carried out in accordance with the Law of Ukraine “On Protection of Consumer Rights”.
5.2.2. The Buyer has the right to return the delivered Goods of proper quality within 14 (fourteen) days from the date of receipt of the Goods, provided that they have not been used, if the product appearance, consumer properties, factory packaging, labels and expense document (goods or cash receipt or other document confirming the fact of receipt of the Goods, with the date indicated) are fully preserved.
5.2.3. Delivery services for the return of Goods of proper quality are paid by the Buyer.
5.2.4. The refund of the funds paid for the Goods is made after receipt of the Goods by money transfer to the Visa/MasterCard card of any bank specified by the Buyer or by account details in IBAN format. If there is a commission from the recipient's bank for the return transfer, it is paid by the Buyer.
5.3. Warranty for the Goods
5.3.1. In accordance with the Law of Ukraine “On Protection of Consumer Rights” and regulatory and technical documentation, the online store shoesbar.com.ua provides a warranty period for the operation of shoes for 30 days from the date of sale or the beginning of the season, in case of purchasing the goods during the off-season:
Winter season from November 15 to March 15;
Summer season from May 15 to September 15;
Spring-autumn season from March 15 to May 15 and from September 15 to November 15.
5.3.2. Warranty period – is the period during which the online store shoesbar.com.ua  undertakes to replace the relevant Product or repair it free of charge in the event of defects that have arisen due to the manufacturer's fault.
5.3.3. In the event of defects being discovered during the warranty period, you must file a complaint and send photos of the defect to the e-mail office@shoesbar.com.ua or to messengers +380968872088.
5.3.4. If the defect is confirmed due to the fault of the supplier, the online storeshoesbar.com.ua  undertakes to act in accordance with Article 8 of the Law of Ukraine "On Consumer Protection".
5.3.5. Minor defects of footwear that can be eliminated without reducing its consumer properties (debonding of decorative welt, falling off of fittings, breakage of zippers, lagging of the heel, slight debonding of the sole, etc.) are not grounds for a refund or exchange of footwear; such defects are eliminated by repair.
5.3.6. In the case of returning a Product that has a significant defect in accordance with the Law of Ukraine “On Protection of Consumer Rights”, the online store shoesbar.com.ua returns funds after receiving and examining the Product. The delivery services of such a Product are paid by the online store shoesbar.com.ua.

6. Rights and obligations of the online store shoesbar.com.ua.
6.1. The online store shoesbar.com.ua has the right:
6.1.1. Unilaterally suspend the sale of Goods and the provision of services (refuse to place an Order, sell and deliver Goods) in the event of a violation by the User/Buyer of the terms of the Public Offer;
6.1.2. At its own discretion, unilaterally change the price of Goods on the Site. The price of Goods confirmed by the online store shoesbar.com.ua  The Order remains unchanged, except for the case when the price may be reduced;
6.1.3. In the event of the absence or impossibility of manufacturing the Goods ordered by the Buyer, exclude this Goods from the Order or cancel the Order, necessarily notifying the Buyer about this using the contact details (telephone, messengers, e-mail) provided by the Buyer when placing the Order;
6.1.4. At its own discretion, unilaterally make changes to the terms of the Public Offer by placing (publishing) it in a new version on the Site. Changes come into force from the moment of their placement (publication), unless another date for the changes to come into force is additionally specified when they are published.
6.2. The online store shoesbar.com.ua obliges to:
6.2.1. After receiving and confirming the Order, execute it properly;
6.2.2. Check the quality of the Goods during its packaging and preparation for shipment;
6.2.3. Send the Goods in accordance with the placed Order and the terms of the Public Offer;
6.2.4. In no way disclose information about the personal data of Users/Buyers.

7. Rights and obligations of the User/Buyer.
7.1. The User/Buyer has the right to:
7.1.1. Select the Goods, place and send the Order on the relevant pages of the Site;
7.1.2. To require the online store shoesbar.com.ua to fulfill the conditions and obligations stipulated by this Public Offer.
7.2. The User/Buyer undertakes to:
7.2.1. Before Accepting this Public Offer, familiarize himself with all its terms and conditions;
7.2.2. Before placing an Order, familiarize himself with the information about the Product (its description) posted on the Site;

7.2.3. Carefully and clearly, guided by the diagrams and description, take the measurements necessary for the manufacture of shoes;
7.2.4. When placing and/or processing an Order, provide the online store shoesbar.com.ua with complete information necessary for the delivery of the Goods. The online store shoesbar.com.ua is not liable in the event that the User/Buyer provides false/incorrect information that has made it impossible for the online store shoesbar.com.ua to properly fulfill its obligations to the Buyer;
7.2.5. Properly pay for and receive the Goods in accordance with the Order;
7.2.6. Upon receipt of the Goods, make sure of its integrity and completeness by inspection. In case of damage or incompleteness of the Goods, record this in the Act, which must be signed by a representative of the Delivery Service Company together with the Buyer;
7.2.7. Read the Rules for the carriage of goods of the Delivery Service Companies before placing the Order.

8. Responsibility of the parties. Procedure for resolving disputes.
8.1. The online store shoesbar.com.ua is not responsible for the quality of public communication channels and possible interruptions in the data transmission network (including, but not limited to, the global Internet), through which access to the Site is provided.
8.2. Any complaint or claim of the User/Buyer must be made in writing/electronic form. The online store shoesbar.com.ua will take all necessary measures to satisfy the complaint/claim of the User/Buyer, if such complaint/claim is justified and drawn up in accordance with the current legislation of Ukraine.
8.3. All disputes, disagreements or claims arising from or in connection with this Public Offer, including those relating to its execution, violation, termination or invalidity, shall be subject to resolution in the appropriate court in accordance with the substantive and procedural law of Ukraine, subject to the conditions of jurisdiction and subordination.

9. Force majeure.
9.1. The Parties are exempt from liability for untimely or improper performance of their obligations if such non-performance is a consequence of extraordinary circumstances, the occurrence of which is not related to the will of the Parties, such as military actions, strikes, riots, accidents, natural disasters, changes in the legislation of Ukraine, as well as other extraordinary circumstances that arose after the conclusion of this Agreement and directly affect the fulfillment of the terms of this Agreement and which the Parties could neither foresee nor prevent.
9.2. The Party for which it became impossible to fulfill its obligations due to the occurrence of force majeure circumstances must immediately inform the other Party in writing/electronically about the occurrence of the above circumstances, and also within 30 (thirty) calendar days provide the other Party with confirmation of force majeure circumstances. Such confirmation will be a relevant document issued by the authorized Chamber of Commerce and Industry of Ukraine or another duly authorized state body located at the place of occurrence of force majeure circumstances.

10. Disclaimer regarding the collection and processing of personal data.
10.1. When accepting the Public Offer, the User/Buyer consents to the collection and processing of personal data in accordance with the Law of Ukraine “On Personal Data Protection”.
10.2. Any information received from the User/Buyer will never and under any circumstances be provided to third parties, except for cases provided for by the current legislation of Ukraine.
10.3. The data provided by the User/Buyer is used to provide him with supporting information on the Order and to ship the Goods according to the Order via delivery services.
10.4. The User/Buyer's personal data is processed in accordance with the Law of Ukraine "On Personal Data Protection".

11. Other.
11.1. The provisions of the current legislation of Ukraine apply to the relationship between the User/Buyer and the online store shoesbar.com.ua.
11.2. The photographs of the Product contained on the Site may differ from the actual appearance. The description/characteristics accompanying the Product do not claim to be comprehensive and may contain typographical errors. To clarify information about the Product, the User can contact the number or e-mail address specified in the “Contacts” section.
